Introduction:
Appeals and enforcement of judgments are where many organisations lose what they won at first instance, or fail to reverse what they lost: recourse deadlines lapse unnoticed, appeal memoranda restate the defence instead of attacking the reasoning, notices are served defectively, and a money judgment sits unpaid because nobody traced the debtor's assets. This Core Concept course equips legal teams to dissect a judgment, choose and argue the right recourse, secure valid judicial notification and run execution to recovery. Participants produce an Appeal Memorandum and Judgment Enforcement Strategy for a case file.
Course Objectives:
- Dissect a judgment into its operative part, reasoning and findings of fact to decide what can be challenged and which recourse fits
- Map ordinary and extraordinary routes of recourse, their filing windows and suspensive effect into a post-judgment deadline docket
- Draft an appeal memorandum that frames grounds of error in law, fact and procedure and requests a precise remedy
